Contract Conditions

This agreement regulates the General Terms and Conditions of purchase of the products offered on this webpage by ROMÀ INFRAESTRUCTURES I SERVEIS, SAU (hereinafter, ROMÀ INFRAESTRUCTURES I SERVEIS or dauliba) holder of NIF no. A25012386 and with registered offices in Av. Dr. Garcia Teixidó, nº 116 de 25242, Miralcamp, LLEIDA (SPAIN). For these purposes, ROMÀ INFRAESTRUCTURES I SERVEIS is registered in the Registro Sanitario de Industrias y Productos alimentarios de Cataluña (RSIPAC) under registration number 16.04711/CAT for the activity of olive oil distribution.

Upon completing the registration process and purchase of any of our products, the CLIENT expressly accepts and submits to the specific clauses below and to the conditions on accessing and using our portal and its privacy policy, available via the link “Legal Notice”.

The CLIENT acknowledges sufficient legal capacity to be contractually bound.

This contract is permanently available in the legal notices on our webpage.

 

  1. PRICES, SHIPPING COSTS, DELIVERY TIME AND TAXES

When buying a product, the CLIENT expressly accepts to pay ROMÀ INFRAESTRUCTURES (dauliba) the specified amounts shown at the time of purchase on the price list of the website www.dauliba.com for the chosen products.

The products offered on this website are subject to Value Added Tax (VAT) that IS INCLUDED in the prices listed for each product.

Shipping costs are NOT included in product prices. For this purpose, the rates are as follows:

1) Spain – Peninsula

Orders up to €19.99: €3 shipping cost
Orders €20 and up: free shipping
Delivery in 24-48 hours

2) Spain – Balearic Islands

Orders up to €30: €7 shipping cost
Orders €30.01 and up: free shipping
Delivery time: 24-48 hours

3) Andorra

Minimum order of €110
Orders up to €149.99: €10 shipping cost
Orders €150 and up: free shipping
Delivery time: 48-72 hours

4) France

Orders up to €99.99: €10 shipping cost
Orders €100 and up: free shipping
Delivery time: 24-48 hours

Once the products have been selected, following confirmation of the order and prior to making payment, the final purchase price will appear on the screen including the VAT (Value Added Tax), and any applicable handling, management, packaging and shipping expenses, which will be shown on the purchase order at the time of purchase and on the bill.

It does not include anything not specified in the description as included.

 

  1. PURCHASE PROCEDURE

Orders on this webpage may only be placed by natural persons aged over 14 and companies.

The webpage sets out all our products individually. The procedure for making and handling the purchase is shown on the webpage and the following steps must be applied:

  1. Choose the desired product.
  2. When selecting an article, you can choose the quantity you wish to purchase and add it to the Shopping Cart; then you can decide to keep on shopping or to process the order.
  3. If this is the first time you are using our webside, to process the order you need to complete a registration form with your personal data and create a personal user account. Once this step is completed, you will receive confirmation of your successful registration at the email address you have provided. If you are already a registered user, just enter the username and password you created for the first purchase to continue shopping. The username code and password are personal and belong to the person who registered who shall be solely liable for their safekeeping. You can manage the information we have and modify or update your data using your account.
  4. The order showing the articles selected one by one will then be checked and the total price will be calculated.
  5. It is also necessary to indicate the billing and delivery addresses for the purchase. A single address may be given for both billing and delivery.
  6. Once this process is complete, you will have to check the box indicating that you have read and accept the terms and conditions.
  7. The systems available for making payment in accordance with the method chosen in each case appear on the webpage.
  8. Once the payment details have been entered, the client must confirm the order by pressing on the “Purchase” button.
  9. After pressing the “Purchase” button, confirmation of your order will be sent by email.

The CLIENT is aware that the photographs and descriptions of the products on the webpage are an approximate image of the products and services offered and that they may differ from the original. The descriptions and illustrations of the products offered on this webpage are solely for information purposes.

 

  1. AVAILABILITY AND DELIVERY

The products offered by ROMÀ INFRAESTRUCTURES (dauliba) are available throughout the European Union and for distribution exclusively in Spain (peninsula) and the Balearics.

For queries about possible distribution and shipping costs to other countries or to the Canary Islands please contact us first at hola@dauliba.com.

In addition, for purchases of more than 18 bottles, please also contact us first at the email address shop@dauliba.com.

Orders will be processed once payment is received correctly.

The products offered by ROMÀ INFRAESTRUCTURES (dauliba) are always subject to availability, as specified on our Website for each product. In case any item is not available, the client will be duly informed of this lack of availability for purchase. Under normal conditions all the products contained on our Website are available for delivery within the timeframes shown.

When a product is out of stock after being ordered by the CLIENT, they will be duly informed and offered an alternative. If the CLIENT is not interested in accepting the alternative and chooses to withdraw the initial order, ROMÀ INFRAESTRUCTURES (dauliba) shall return any sums paid and inform them of the steps and timeframe of the reimbursement.

As a general rule, the maximum delivery time to an address located in Spain (peninsula) is between 24 and 72 working hours, while for the Balearics the delivery time is between 48 and 72 working hours, as from the time of purchase and when payment has been confirmed. These delivery times are approximate and under no circumstance binding upon ROMÀ INFRAESTRUCTURES (dauliba).

Deliveries will take place on working days (from Monday to Friday) during business hours (from 9:00 a.m. to 7:00 p.m., depending on the transport company, the courier route and, if applicable, the country). The CUSTOMER is advised to indicate their time preferences for the delivery when filling in the details of their order in the Comments section

The product purchased will be delivered to the address by the forwarder, together with the delivery note and the commercial invoice for the sale on paper to the address given on the purchase order the client signs as acknowledgement of receipt. In addition, the CLIENT will be duly advised if any incident occurs or if the delivery is delayed for any reason.

If the delivery to the address indicated is not possible due to the addressee’s absence, the forwarder will directly contact the CLIENT giving details on how to proceed. In case theIn case the delivery is impossible due to the address being wrong, the cost of re-shipping the order will be borne by the CLIENT. ROMÀ INFRAESTRUCTURES (dauliba) is not liable for any delay in deliveries of parts purchased when the cause is attributable to the forwarder.

In order that the CLIENT is informed at all times of the handling of the purchase we will send an email confirming the order and payment. We will also send a notice informing that the order is ready for shipment.

  1. PAYMENT AND PAYMENT PERIODS

The following forms of payment are accepted:

  • Debit and credit cards: The transaction is carried out by connecting directly to La Caixa (CaixaBank) via its payment gateway.

Once payment is made you will receive a confirmation email.

ROMÀ INFRAESTRUCTURES (dauliba) will not have any knowledge of your credit card details. All our payment systems are fully secure.

Payment are prior to delivery of the product and therefore ROMÀ INFRAESTRUCTURES (dauliba) will not supply the product ordered until such time as it has received payment of same.

ROMÀ INFRAESTRUCTURES (dauliba) reserves the right to temporarily or definitively cancel any orders placed due to any incident affecting collection of same.

 

  1. BILLS

Upon making payment, you will receive the Bill for your purchase in PDF format at the email address you provided when processing the order.
In addition, the original of the invoice will be delivered together with the product purchased at the time of delivery.

The CLIENT is responsible for confirming reception of any notifications and informing us of any modification to their details, and ROMÀ INFRAESTRUCTURES (dauliba) shall not accept any liability arising from this circumstance.

 

  1. WARRANTY

At ROMÀ INFRAESTRUCTURES (dauliba) we strive to offer services of the highest quality although, given the nature of same, we cannot offer guaranteed satisfaction. Should you fail to receive the service correctly for any reason, you should inform us as soon as possible, describing the incident which, after verifying the error, we will remedy as soon as possible.

The warranty document is the purchase receipt.

The composition of the products is that shown in the description on its specifications sheet. ROMÀ INFRAESTRUCTURES (dauliba) is not liable for any possible effects caused by allergic reactions to the components of same.

 

  1. RETURNS

Returns or product changes will only be accepted in the event of factory defects, damages during shipping or delivery errors.
In any event, no more than 10 days must have elapsed from receipt of the product; and the packaging and accessories must be included.

Verification will be performed prior to the acceptance of the existence of any defects or anomalies in the manufacturing or packaging together with inadequate or negligent use, handling or storage. Products will always be accompanied by the appropriate delivery note or bill.

In the event of a return due to a manufacturing or packaging defect or any error in the order, the CLIENT will be offered, if possible, repair of the item or replacement by an alternative at no additional cost and without any right to compensation on the part of the CLIENT. Expenses arising from shipping the repaired or correct order will be borne by ROMÀ INFRAESTRUCTURES (dauliba).

In any event, the return will be subject to ROMÀ INFRAESTRUCTURES (dauliba) first examining the condition of the product returned and verification that the requisites necessary under these terms of sale have been complied with. Once the return has been received and if applicable, we shall refund the sum paid within a maximum of 30 days and under the same terms as used for making payment.

ROMÀ INFRAESTRUCTURES (dauliba) reserves the right to reject returns reported or shipped after the term provided or products not in the same condition as when received.

Returns will be handled by sending an email to hola@dauliba.com describing the reasons and causes alleged for the return. It is also necessary to include the name and surnames and reference number of the order. Once the request has been received, we shall process it accordingly.

 

  1. RIGHT OF WITHDRAWAL

You have the right to withdraw from this contract within 14 calendar days without explanation, unless subject to any of the exceptions provided in article 103 of Real Decree Law 1/2007, 16 November, on the Protection of Consumers and Users. For this purpose, the consumer is informed that given the nature of the product, the right of withdrawal will not apply to sealed items which are not suitable for returning due to health or hygiene reasons and which have been unsealed following delivery.

When eligible to withdraw from this contract, the withdrawal period will expire after 14 calendar days as from the day you or a third party, other than the forwarder, took material possession of the items.

To exercise this right of withdrawal you must notify us at ROMÀ INFRAESTRUCTURES I SERVEIS, S.A.U., Av. Dr. Garcia Teixidó, nº 116 de 25242, Miralcamp, LLEIDA (SPAIN) or in the email: hola@dauliba.com, your decision to withdraw from the contract via an unequivocal statement (for example, a letter sent by post, fax or email). You can use the withdrawal form that appears below, although this is not compulsory.

To comply with the withdrawal period notice of this right being exercised should be sent before the corresponding timeframe has expired.

Consequences of withdrawal:

Should you decide to withdraw, we will refund all payments received from you including the delivery costs (except any additional expenses arising from your choosing a different delivery method to the less expensive ordinary delivery method we offer) without undue delay and at the latest 14 calendar days as from the date on which you inform us of your decision to withdraw from this contract.

You will bear only the direct cost of returning the items, so the collection cost will be deducted from the refund, unless the cause is faulty quality, error in the shipment on our part.

We will perform the refund using the same payment method used by you for the original transaction, unless you have expressly instructed otherwise; you will incur no expenses as a result of this refund.

We inform you that we may retain this refund until we receive the items or until you present proof of their return, whichever occurs first.

Once the request for withdrawal has been notified, you must return the items ROMÀ INFRAESTRUCTURES I SERVEIS, S.A.U., Av. Dr. Garcia Teixidó, nº 116 de 25242, Miralcamp, LLEIDA, without undue delay and within a maximum of 14 calendar days at the latest as from the date you inform us of your decision to withdraw from the contract. This timeframe will be considered met when the items are returned before said period has expired.

The items returned must be in perfect condition, undamaged, without any deformation or any signs of wear and tear, scratching or staining. You will be liable for any reduction in the value of the items resulting from any handling other than that necessary to establish the nature, characteristics and operation of the items.

 

  1. PERFECTION OF THE CONTRACT AND MODIFICATION OF SERVICES

This contract is perfected by payment of the product and shipping to the CLIENT with a confirmation email containing a description of the purchase.

ROMÀ INFRAESTRUCTURES (dauliba) reserves the right to modify in any manner any of the characteristics and conditions of its services with a view to enhancing same and benefitting the CLIENT.

 

  1. OBLIGATIONS OF THE PARTIES

ROMÀ INFRAESTRUCTURES (dauliba) undertakes to supply the CLIENT with the products and services acquired, using due diligence in providing the service and safeguarding the necessary facilities for operation of the network, for which purpose it has adequate technical and IT equipment and to manage the logistics, shipping and delivery of the purchase by means of the forwarder.

The CLIENT undertakes to use the services at their disposal in good faith without infringing any laws or third-party rights and to pay for the product selected in the manner and at the time set forth in these sales conditions and upon receipt at the place indicated for delivery.

ROMÀ INFRAESTRUCTURES (dauliba) does not warrant that the availability of the service referred to herein is continuous or uninterrupted due to circumstances originating as a result of Internet issues, breakdown of IT devices or other unforeseeable circumstances. The CLIENT therefore accepts to tolerate these circumstances within reasonable limits and expressly waives any claim against ROMÀ INFRAESTRUCTURES (dauliba) for any contractual or extra-contractual liability for any failures, errors or use of the service engaged.

 

  1. COMMUNICATIONS

All and any notices between the parties shall be preferably via email. The CLIENT is responsible for confirming reception of any notices and informing ROMÀ INFRAESTRUCTURES (dauliba) of any modification to their details, and the latter shall not bear any liability arising from this circumstance. In the event of a modification, the CLIENT must inform ROMÀ INFRAESTRUCTURES (dauliba) by email or by calling the telephone numbers appearing on our webpage.

Pursuant to article 21 of Law 34/2002 on Information Society and Ecommerce Services we inform you that are commercial communications and information relating to our website and the products offered there will be carried out by email to the address provided, which will be revocable. You have in any event the option of rejecting our commercial communications by sending an email to hola@dauliba.com with the subject line UNSUBSCRIBE.

 

  1. COMMITMENT, ACCEPTANCE AND VALIDITY OF THE CONTRACT

The CLIENT acknowledges having read and accepted the legal conditions of use and privacy policy of the webpage.

The CLIENT acknowledges they have understood all the information regarding the products and services including, if applicable, those of delivery as presented on our webpage together with all the conditions and stipulations contained herein and attests that they are sufficient to exclude any error in consenting hereto and therefore expressly accepts same in full.

The CLIENT is fully aware that the acceptance and execution of this contract shall take place by providing their data and by pressing the “Purchase” button on our webpage and perfected by payment of the service.

 

  1. APPLICABLE LEGISLATION.

This contract is commercial in nature and shall be governed and construed pursuant to Spanish law.

Should any type of discrepancy or dispute arise between the parties as to the construction, content or execution hereof which is not resolved by mutual agreement, the Parties shall submit to the competent courts provided the user is a consumer.

In those cases in which it may be foreseen that the Parties may submit to a forum, they shall submit to the Courts of Lleida (Spain) and expressly waive any other to which they may have recourse.
